Image uploads (Custom case designer)
You must ensure that all images uploaded or submitted to casestation.com are either owned by you or you own the correct license for their reproduction in print. Images must comply with the terms and conditions of use on casestaiton.com. It is your responsibility (as the customer) to obtain the correct image usage rights for any images supplied to CASE STATION. It is your sole responsibility to confirm that images do not infringe a third party owner’s copyrights, trademarks or any intellectual property laws. If we believe an image to be in breach of copyright law we will first contact you to provide us with evidence that you hold the correct license for the image. If this is not provided we reserve the right to cancel your order and provide you with a full refund. CASE STATION cannot accept any liability whatsoever for any breach of copyright concerning material and artwork supplied by the customer and it is the customer’s responsibility to take every reasonable action to ensure no breach of copyright exists. CASE STATION reserves the right to refuse any custom case order we find to be offensive.

International Customers
If Goods are being ordered from outside the UK (CASE STATION’S country of residence), import duties and taxes may be incurred once your Goods reach their destination. CASE STATION is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and CASE STATION cannot guarantee that the packaging of your Goods will be free of signs of tampering.
1. Intellectual Property
1.1 Subject to the exceptions in Clause 2 of these Terms and Conditions, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of CASE STATION, our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United States and international intellectual property laws and other laws.
1.2 Subject to Clause 7 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by CASE STATION.
2. Third Party Intellectual Property
2.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
2.2 Subject to Clause 3 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Web Site or unless given express written permission to do so by the relevant manufacturer or supplier.
3. Fair Use of Intellectual Property
Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Cpyright, Designs and Patents Act of 1988 apply, or where written permission has been obtained from Case Station, Ltd.

This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of CASE STATION or that of our affiliates. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.
5. Accounts
In order to purchase Goods on this Web Site and to use the custom case designer, you are required to create an account that will contain certain personal details and Payment Information which may vary based upon your use of the Web Site as we may not require payment information until you wish to make a purchase. We will only use any information collected from you in accordance with the Data Protection Act of 1998. CASE STATION will not sell or pass on any personal data to any third party unless obliged to do so by UK government authorities or by order of a court of competent jurisdiction. We may send you email newsletters with the latest offers or products. You can opt-out of receiving these by using the unsubscribe link in each such email.
6. Termination and Cancellation
6.1 Either CASE STATION or you may terminate your Account. If CASE STATION terminates your Account, you will be notified by email and an explanation for the termination generally will be provided. Notwithstanding the foregoing, we reserve the right to terminate accounts without giving reasons for doing so.
6.2 If CASE STATION terminates your Account, any current or pending purchases on your Account will not be cancelled and will be dispatched to you.
6.3 CASE STATION reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch.
6.4 If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.
7. Goods, Pricing & Availability
7.1 Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from CASE STATION correspond to the actual Goods, CASE STATION is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether.
7.2 All pricing information on the Web Site is correct at the time of its going online. CASE STATION reserves the right to change prices and alter or remove any special offers from time to time and as necessary.
7.3 All prices on the Web Site include VAT. CASE STATION Ltd is VAT registered.
8. Shipping
8.1 CASE STATION aims to deliver all orders within 7 working days. Custom cases typically take slightly longer than stock items to receive. For addresses in remote locations, Royal Mail advises they may take slightly longer to arrive.
8.2 International Shipping. For all International orders it is the responsibility of the recipient to pay Customs Duties and Taxes and charges levied by the country of destination. CASE STATION aims to keep sufficient items in stock to fulfill orders within the above timescales. If there is a foreseen delay in achieving this you will be informed as soon as possible. You will then have the choice to either wait until your items come back into stock or to cancel your order. CASE STATION will only ship orders when full payment has been received and authorised. If CASE STATION receives no communication from you, within 3 days of deliver, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems.
9. Guaranties and Returns Policies
9.1 Guarantee for the life of your Case Station™ Case. Congratulations on receiving your Case Station™ case, the industry’s standard for workmanship, quality and durability. Your case is guaranteed by Case Station to be free from defects in materials and workmanship under normal conditions of use for the lifetime of the product. This guarantee is extended to the original purchaser or gift recipient of the case. Proof of purchase or of receipt as a gift may be required.
9.1.1 Should you have a problem with a Case Station case, either with respect to the image quality or due to breakage of or damage to the case itself, please email us at [email protected] You will be provided with information on the return of your case for a replacement at no cost to you, subject to the stipulations in paragraph 9.1.2 below regarding Custom or personalized cases.
9.1.2 For a return requested due to issues with the quality of the decoration or image, it is very important that the problem be reported to Case Station within ten (10) days of receipt of the case so that there will be sufficient time for return of the case and incorporation of the original art work into the replacement case. This provision is necessary because, to protect the privacy of its clients, Case Station does not store customer-supplied images for longer than thirty (30) calendar days.
9.1.3 In the event that circumstances do not permit the return of a defective case before the original image retention period expires, Case Station Customer Service will provide instructions regarding ordering a replacement case at no additional charge.
9.1.4 For returns due to damage to or breakage of the case, contact Case Station in the same manner as noted above at any time to arrange for return of the case and its replacement.
9.1.5 This guarantee, and other guarantees contained herein that may apply, covers damage caused by normal wear and tear, accident or non-commercial use. Incidental or consequential damages are expressly excluded from this and other guarantees contained herein. This guarantee, or others contained herein, does not affect any statutory rights that you may have.
9.2 All other Goods sold by Case Station on this website are guaranteed for a period of twelve (12) months from the date of purchase, wear and tear through normal usage or any commercial use excepted. This guarantee is extended to the original purchaser or gift recipient of such Goods and proof of purchase or gift receipt may be required.
9.3 We are confident you will love your new phone case or other product(s) ordered, and CASE STATION aims always to provide high quality Goods that are fault free and undamaged. On occasion however, Goods may need to be returned. For personalised cases we are unable to offer you a refund, but if your case or other product arrives damaged or faulty we will replace it, subject to conditions noted further below. See below falso or details on faulty Goods returns. All other returns are governed by these Terms and Conditions.
9.4 If you receive custom or personalized Goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 10 days to arrange collection and return. CASE STATION will accept responsibility for paying return shipment costs but you need to contact us to properly arrange returns. You will be given the option to have the Goods replaced with those ordered (if still available) or to be refunded through the payment method used by you when purchasing the Goods. Refunds and replacements will be issued upon our receipt of the returned Goods.
9.5 If any Goods, other than custom or personalized cases, that you have purchased have faults when they are delivered to you, you must contact CASE STATION within 28 days to arrange collection and return. Goods must be returned in their original condition with all packaging and documentation. Upon receipt of the returned Goods, you will have the option of having the Goods replaced (if still available) or of having the price of the Goods, as paid by you, refunded to you through the payment method used by you when purchasing the Goods.
9.6 If Goods are damaged in transit and the damage is apparent on delivery, you should sign the delivery note to the effect that the goods have been damaged. In any event, you should report such damage to CASE STATION within 10 days and arrange collection and return. Upon receipt of the returned Goods, you will have the option of having the Goodsreplaced (if still available) or of having the price of the Goods, as paid by you, refunded to you through the payment method used by you when purchasing the Goods.
9.7 You have a right to a “cooling off” period. This period begins once your order is complete and ends 7 days after the Goods have been delivered. If you change your mind about the goods within this period, please return them to CASE STATION within 7 days of receipt. Goods can only be returned for this reason if their packaging remains unopened and the Goods can be re-sold, as new, without any additional work on the part of CASE STATION. You are responsible for paying shipment costs if Goods are returned for this reason. Note that custom or personalized goods are not covered by this provision.
9.8 If you wish to return Goods to CASE STATION for any of the above reasons, please contact us using the details on our contact page to make the appropriate arrangements.
9.9 CASE STATION reserves the right to exercise discretion with respect to any returns under these Terms and Conditions. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
9.9.1 Any use or enjoyment that you may have already had out of the Goods;
9.9.2 Any characteristics of the Goods which may cause them to deteriorate or expire rapidly; 9.9.3 The fact that the Goods consist of audio or video recordings or computer software and that the packaging has been opened;
9.9.4 Any discounts that may have formed part of the purchase price of the Goods to reflect any lack of quality made known to the Customer at the time of purchase. Such discretion to be exercised only within the confines of law.
10. Disclaimers
10.1 CASE STATION makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Services.
10.2 No part of this Web Site is intended to constitute advice and the content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.
10.3 No part of this Web Site is intended to constitute a contractual offer capable of acceptance.
11. Changes to the Service and these Terms and Conditions
CASE STATION reserves the right to change the Web Site, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Web Site following the changes. If CASE STATION is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.
12. Availability of the Web Site
The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. CASE STATION accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
13. Limitation of Liability
13.1 To the maximum extent permitted by law, CASE STATION accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.
13.2 Nothing in these Terms and Conditions excludes or restricts CASE STATION’s liability for death or personal injury resulting from any negligence or fraud on the part of CASE STATION.
13.3 Nothing in these Terms and Conditions excludes or restricts CASE STATION’s liability for any direct or indirect loss or damage arising out of the incorrect delivery of Goods or out of reliance on incorrect information included on the Web Site.
13.4 Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevantprovisions of the Unfair Contracts Act of 1977, if any of these terms are found to be unlawful, invalid or otherwise unenforceable, such a term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This provision shall apply only within jurisdictions where any such particular term is illegal.
14. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, that shall not be construed as a waiver of that right or remedy.

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Such notice will be deemed received 3 days after posting if sent by first class mail, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

These terms and conditions and the relationship between you and CASE STATION shall be governed by and construed in accordance with the laws of England and Wales, and CASE STATION and you agree to submit ot the exclusive jurisdiction of the courts of England Wales.
18. Security and Privacy Policies and Use Of “Cookies”
18.1 We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. In addition, please note that emails, messages sent via your web browser, and other similar means of communication with us are not encrypted. We strongly advise you not to communicate any confidential information through these means. Therefore, while we strive to protect your information, we cannot guarantee its security.
